These terms apply if you join the PositionBoss Partner Program ("Program") to recommend Gold Position Manager ("the Software") and earn a commission.
1. Joining
You apply through our partner page. We may accept or refuse an application without giving a reason. You must be at least 18 and able to make contracts. You act as an independent business, not as our employee, agent or representative, and you may not make promises or agreements on our behalf.
2. How sales are tracked
Sales are tracked through your personal link and a cookie that lasts 60 days, by the affiliate system of the Reseller or of a tracking provider we use. If a visitor blocks or refuses tracking, a sale may not be tracked; we cannot pay commission on sales that were not tracked.
3. Commission
- For each tracked sale you earn a share of the price the buyer paid, without taxes and after any discount code:
- 30% on lifetime licences and on the first payment of yearly plans;
- 25% of each monthly payment during the first 12 months of that subscription;
- 40% instead, on sales made after you have reached 25 tracked sales that were not refunded (Pro partner).
- If the tracking system cannot pay commission on monthly renewals, you receive 35% of the first monthly payment instead. Renewals of yearly plans earn no commission.
- We give you a personal discount code that gives your audience 10% off. Sales with your code count for you as far as the tracking system can link them to you; share the code together with your link.
- No commission is paid on your own purchases, on purchases by people in your household, or on sales that are refunded, charged back or fraudulent. A commission already paid for such a sale is deducted from later payouts.
- Each commission is held for 30 days. It is then paid to you twice a month, by the Reseller or by us, once your balance reaches 50 USD, with the payout methods available in your country. The payout provider may charge a fee. You are responsible for your own taxes.
4. How you may promote the Software (very important)
You must promote the Software honestly and lawfully. In particular you must not:
- promise or suggest profits, income, a win rate, "financial freedom", becoming rich or a millionaire, or that the Software prevents losses;
- use words like "guaranteed", "risk-free", "never lose", "the best" or "number one", or any claim you cannot prove;
- show trades, results or screenshots as typical, or edit or invent them;
- give investment advice or trading signals together with our name or link, or suggest that we approve them;
- pretend to be PositionBoss, or create websites, accounts or names that can be confused with ours;
- buy search ads on our brand names ("PositionBoss", "Gold Position Manager"), or use them in domain names;
- send spam (unrequested e-mails or messages), use fake reviews, cookie stuffing, pop-ups that force clicks, or incentives such as paying people to click;
- target people under 18, or people in countries where promoting leveraged trading or trading software is not allowed.
You must:
- state clearly and close to every link that you earn a commission (for example "I earn a commission if you buy through this link"), as required by the FTC in the US, the CAP Code in the UK and consumer law in the EU, Australia and elsewhere;
- show a clear risk warning with every promotion, for example: "Trading gold carries a high risk of loss. Gold Position Manager is a tool and cannot promise any result.";
- follow the law of your country, including rules on financial promotions, advertising, consumer protection, privacy and e-mail marketing, and the rules of every platform you use (for example YouTube, Meta, Google, TikTok, Telegram);
- use only the descriptions, images and videos we provide, or your own honest ones.
5. Our rights
We may review your promotions, ask you to change or remove them, withhold commission for sales that came from promotions that break these terms, and end your participation. If a breach exposes us to claims or fines, you will compensate us for the resulting losses and reasonable costs.
6. Brand use
While you take part, you may use our name, logos and materials only to promote the Software and only as we provide them. This permission ends when your participation ends.
7. Liability
As far as the law allows, our total liability to you under the Program is limited to the commissions paid or owed to you in the 12 months before the claim. We are not liable for lost profits or indirect losses, or for errors or outages of the tracking or payout systems.
8. Changes and ending
We may change these terms or the commission rate with 30 days notice by e-mail; the change does not affect commission already earned. Either side may end participation at any time. Commission earned on tracked sales before the end is paid as usual, unless it came from a breach of these terms.
9. Law
Sections 26 and 27 of the Licence Agreement apply to these terms in the same way.
